Every booking platform does it now: a badge reading 'only 3 tables left', a countdown that ticks down, a line saying '12 people are looking at this right now'. On a plane seat or a hotel room, that number is almost always invented — there aren't really 3 seats; there are hundreds of price-and-date combinations the system simply chooses not to show. A restaurant is different. A room with 60 seats has exactly 60 seats. If you genuinely have only 3 tables left tonight, that isn't a marketing trick — it's just your floor plan. This article doesn't answer whether scarcity works. That's been proven a hundred times over. It answers: how do you know whether the number you're showing is true — and what it costs you when it isn't.

Restaurants are one of the few businesses where honest scarcity genuinely exists. An online shop can always order another box; your dining room has exactly as many tables at 8pm as it has, and no supplier is delivering more tonight. That's a difference most owners never use — most either show nothing at all, or copy whatever the hotel industry does: a badge set once when the booking widget was installed, and never touched again.

And that second habit is exactly where it goes wrong. A badge that says 'only 3 left' on a quiet Tuesday lunch and on a fully-booked Saturday in July has stopped being a scarcity signal — it's decoration. A guest who visits twice and sees '3' both times learns within minutes that the number means nothing. And if a regulator ever checks, a badge that never changes is precisely the evidence that it was never a real-time count — it was an invented figure.

Why scarcity works differently for a restaurant than anywhere else

The scarcity effect itself isn't new: as far back as 1968, researcher Timothy Brock showed that people value something in proportion to how hard it is to get — what's known as commodity theory. Robert Cialdini included it decades later as one of his six principles of persuasion in Influence, and 'only X left' has been on nearly every booking screen on earth ever since.

What's different at a restaurant is the hard ceiling. An online shop can always let an item show as 'sold out' based on a stock number the system itself chooses to display — there's no physical reason more stock couldn't simply exist. Your dining room has exactly as many tables tonight as it has. That ceiling doesn't exist because a system was configured that way; it exists because there is literally no extra chair to add without breaching fire-safety limits.

That makes restaurant scarcity one of the few places where the honest version is also the strongest signal — and the only one that still holds up if someone checks it. A guest who calls at 7pm and hears "we genuinely have one table left for two" believes it faster than a badge would, precisely because they know a restaurant has a ceiling. Inventing that ceiling instead of showing it as it is throws away the one advantage hospitality has over every other industry that leans on scarcity.

The four rules

In the order they build on each other: first why it can genuinely be true, then what the law has said since 2005, then how to check it yourself, and finally why it matters whether you get it right.

1. Only show it if it's a snapshot, not a setting

The rule is easy to state and hard to keep: a scarcity number may only show what is true right now, and must move the moment that changes. The instant a table books, the number should drop. The instant someone cancels, it should rise again. A number that was set to '3' when the widget was installed and hasn't moved since isn't a scarcity signal — it's decoration that happened to be accurate once.

That distinction — snapshot versus setting — is exactly what regulators look at, and it's also the easiest thing to check yourself. Reload your own booking page on two different days. Does the number change? Then it's probably real. Does it stay exactly the same, even on a day you know for a fact the room is half-empty? Then you're showing a setting, not reality.

Not every signal that DOES change is automatically honest, either — there are at least four kinds that genuinely track reality, and at least four that deliberately imitate it without being it. All eight sit side by side further down, in one table, with what each one means under EU rules.

2. What the EU has banned since 2005 — with real teeth since 2022

This isn't a new law. Annex I, point 7 of the EU's Unfair Commercial Practices Directive (Directive 2005/29/EC) has sat on the so-called blacklist of practices banned in every circumstance for two decades: "falsely stating that a product will only be available for a very limited time... in order to elicit an immediate decision and deprive consumers of sufficient opportunity or time to make an informed choice." No grey area, no weighing of context — if the number is invented, the breach is already complete.

What did change is enforcement. Since the so-called Omnibus Directive (2019/2161/EU), applicable since 28 May 2022, member states must be able to fine a company up to 4% of its annual turnover in the member states concerned — or up to €2 million where turnover data isn't available — for a widespread infringement. That's not a small-print fine anymore; that's a share of your revenue.

And it isn't a theoretical risk. In 2019 the EU's network of consumer authorities (the CPC Network), together with the European Commission, opened a coordinated investigation into major booking platforms — including Booking.com and Expedia — over exactly this pattern: countdown timers, unverifiable 'X people are looking at this' messages, and pressure to decide quickly. Both platforms committed to changing their interfaces as a result. Any booking widget copying the same pattern today is copying something regulators have already acted on once.

Which signals a regulator could actually check

A score for how verifiable each signal is: could someone from outside confirm the number is true? Nothing to the right of the line can be checked — and that's exactly where the blacklist starts.

All four imitations score under 30% — not because they're unlikely, but because there's literally no source to check them against.

3. Only say it when it's true — the real availability ratio

There's one sum that separates an honest number from a risk: how many tables you genuinely have free tonight, against what you're showing. That first figure is three steps: how many tables your room has, minus how many are already booked, minus the buffer you — as our guide on the reservation buffer covers — deliberately hold back for late arrivals or a running service.

That buffer is the detail most owners forget. A 15-table room with 10 booked and 2 deliberately held back as slack genuinely has 3 tables free — not 5. So the number you display has to account for what you've already set aside yourself, or you're telling guests something that doesn't even match your own floor plan.

4. A false alarm trains guests to ignore you

There's a well-documented mechanism in the psychology of warnings, first named by psychologist Shlomo Breznitz in his 1984 book Cry Wolf: the more often an alarm turns out to be false, the less people respond to the next one — even when that next one is genuine. It's the same mechanism as a fire alarm that goes off too often for no reason: by the third time, nobody walks outside anymore.

Scarcity signals work identically, and it's exactly why a fixed badge costs more over time than it earns. The first time a returning guest sees '3 tables left' and still manages to book a table for next week, they still believe it. The third time they see the same number — on a busy night and a quiet one alike — they stop reacting to it. And on the night it's genuinely true, that same guest ignores the exact signal that should have pushed them to book now.

That's the opposite of what scarcity is supposed to do. The chart below shows the pattern that false-alarm research keeps finding: the more times someone catches a claim being false, the less likely they are to believe the next one. It's an illustrative model of that mechanism, not a measurement of any one restaurant — but the direction of the curve is exactly why an honest number earns more over time than one that merely happened to be right once.

Two things worth keeping in mind. The gap between overstating and understating isn't symmetric: the first is what EU law targets, because it pressures a guest to decide faster than necessary. The second isn't a violation, but it is a missed booking — and just as credible, over time, as a number that simply happens to never be true.

And a number that's accurate today can be wrong again tomorrow. A booking widget that automatically counts what comes in only has to be set up correctly once. A badge you update by hand needs checking as often as you show it — which is exactly why most venues eventually choose either a number that moves automatically, or no number at all.

  • Pick one or two of the four honest signals (a fixed portion count, the last seating) that genuinely fit how your venue runs.

The only signal that keeps working is the one that's true

Most restaurants that run these numbers for the first time land in the same place: the figure on their booking widget was set once by whoever built the website, never touched again, and correct on some nights and wrong on others purely by chance. That isn't bad faith — it's a setting nobody's attention ever reached, sitting on exactly the spot where the law has said precisely what is and isn't allowed for two decades.

The good news is that a restaurant has something almost nobody else has: a ceiling that genuinely exists. Where an online shop has to pretend stock is limited, a restaurant usually doesn't need to pretend anything — the room is either full or it isn't. Showing that honestly wins twice: no risk under EU rules, and a signal a guest still believes on the night it actually matters.
